How does the federal government defend their statement of making marijuana illegal?

In what ways can the government defend their position of criminalizing the use of marijuana (or any controlled substance for that matter) through the use of the constitution. If I'm not mistaken all aspects not addressed in the constitution are reserved to the states. How is criminalizing certain substances acceptable, where as it is not for similarly harmful substances such as tobacco or alcohol?


How does the government justify making cigarettes legal and marijuana illegal? That's the question over 42% of Americans have been asking themselves since the 70's. There are many reasons why our government is playing monopoly with this issue. First on the list is the Religious Right which has always had a lot of pull in government. Firmly believers that marijuana is dangerous evil drug that destroys lives. 2) Paper, and textile manufacturers lobbyists are stalling it because they don't not want the competition. 3) Many say the CIA has fought to keep it illegal in order to maintain a artificial market; which allows them to run drugs and raise money for "Black Projects."

It's sad really when you look at how many non violent drug offenders behind bars in this country. It is a shame that we have decided to incarcerate these people rather than treat them and provide an alternative to such damaging behavior. Politicians are hooked on the prison money they get from all these non violent drug offenders in jail. Don't forget all the private prison industry lobbyist as well.

I don't see anything in the Constitution forbidding the government from abolishing or restricting the use of any drugs deemed harmful to the public, but it can certainly be argued that it irrationally discriminates against some drugs more than others. Nobody has yet given a good scientific reason as to why weed (a drug that just makes you lazy and gives you the munchies) is completely illegal, and yet alcohol (a proven factor in causing violent and aggressive behavior, and actually causes people to get killed) is still legal. Apparently any drug used by the conservative middle or upper class is considered perfectly OK, but any drug used by minorities or poor people in general must be considered dangerous. I say we should just legalize most drugs, but regulate them in a more fair and balanced way which addresses their real physiological effects on people and is not tainted by class or racial discrimination.

A question that will never honestly be answered. Tobacco and alcohol have done WAY more damage to our country and our citizens than marijuana. Our whole way of thinking is F'd up sometimes. Some things you just can't explain.

In the Articles of the Constitution, CONGRESS can make those little annoying laws about drugs. By the way, we still have two ammendments about the use of alcohol too.

Good question cause tabacco and Alcohol along with Marijuana all should be taken from this country. Because nothing good comes out of any of these drugs!

The Federal Government did this as a racist act back in the 1920's. It was an easy way to get rid of Mexicans. Look it up!
