How does the federal government have the power to institute the draft?

Nowhere in the Constitution does it say that the government can institute the draft, how can it be legal if they force people to go to war?


Elastic clause

They have the power to make "all laws necessary and proper" to exercise their rights. They have the right to fight a war, therefore if a draft is necessary to fight a war, they have the power to draft.

Conscription is part of the common law of every country.

Bush drafted a lot of people by extending their tours of duty and by forcing the Individual Ready Reserve back into service.
